The Telephone Preference Service (TPS), Corporate Telephone Preference Service (CTPS) and Fax Preference Service (FPS) now make it illegal to make a direct marketing call or send a fax to a consumer, sole trader or a partnership (except Scotland) that registered with the scheme more than 28 days previously. The law is enforced by the Information Commissioners Office (ICO) and the penalties can be very severe for non compliance. Both the availability of daily updates and the 28 day rule dictate that telephone numbers must be screened, at the very least, every 28 days and against the most current version of the TPS file. Organizations with which you have an ongoing relationship, e.g. those that regard you as a customer or donor (in the case of charities) are entitled to call you even if your number is on the TPS, unless you have previously told them specifically that you object to them calling you for marketing purposes although these companies should not pass on your details to any third parties that may wish to contact you, via the telephone, for direct marketing purposes. You supply us with your addresses, including telephone number, and we match your telephone numbers against the TPS file, flagging those that have subscribed to the scheme.
